Non-resident status
In simple terms, a non-resident is a person who permanently lives abroad. However, for legal purposes, the status is determined by a strict hierarchy of criteria:
- Centre of vital interests: If a person has closer personal or economic ties with another country (for example, their family lives there or their primary business is registered there), they may be considered a non-resident.
- 183-day rule: If a person spends fewer than 183 days in total in Ukraine during a calendar year, they are generally considered a non-resident.
- Citizenship: If status cannot be determined by the above criteria, the person is considered a resident of the country whose citizenship they hold.
Important: A Ukrainian citizen can be a non-resident if they permanently reside abroad. Conversely, a foreign national can become a tax resident of Ukraine.
